The company positions ZCSH as a high-risk satellite position within a digital asset portfolio. It is important to note that at the time of ZCSH's listing, the serious privacy system vulnerabilities previously disclosed by Zcash are still under market scrutiny. In May of this year, researchers discovered exploitable vulnerabilities in the Zcash Orchard privacy pool, which theoretically could allow attackers to forge ZEC. Zcash subsequently deployed an emergency patch in June and activated the Ironwood upgrade in July to replace the vulnerable Orchard privacy pool and limit the potential circulation of forged ZEC through new supply accounting rules. Grayscale indicated that it will focus on the adoption of the Ironwood upgrade, network security, exchange support, and regulatory policies regarding privacy assets in the future.

On August 25, Brent Kovar, a businessman from Las Vegas, Nevada, was found guilty by a federal jury of running a cryptocurrency Ponzi scheme that defrauded at least 400 investors of approximately $24 million. Kovar was convicted on 11 counts of wire fraud, 2 counts of mail fraud, and 2 counts of money laundering, with sentencing scheduled for November 30, where he faces a maximum statutory sentence of 280 years. Kovar, along with his mother Joy Kovar, previously operated Profit Connect, attracting investors from late 2017 to July 2021 under the guise of blockchain mining and other businesses, claiming to possess an AI-enabled 'supercomputer' that could deliver fixed annual returns of 20% to 30% with monthly compounding. The U.S. Department of Justice stated that Kovar actually used investor funds to pay returns to other investors in a manner similar to a Ponzi scheme, transferring millions of dollars into his mother's personal bank account and using investment funds to purchase gifts and personal real estate. The U.S. SEC had already filed a fraud lawsuit against Kovar and his mother in 2021, accusing them of illegally raising approximately $12 million from at least 277 investors. The amount involved in the federal criminal case has now expanded to approximately $24 million.
